OSHA 1926.51: 95 workers on a November 2026 site. Toilets and urinals?

OSHA 1926.51 requires one toilet seat and one urinal per 40 workers for a crew of 95. You need three toilet seats and three urinals on site.

Unit types
A standard portable toilet is the most common for construction. A deluxe portable toilet with a flushing bowl and sink is an upgrade. An ADA-compliant portable toilet is required by the ADA cluster rule if you cluster units. A restroom trailer is for high-end sites with power and water access.

Placement and service
Place units on level ground with truck access for weekly service visits. Use staking and tie-downs in windy areas. November weather may require winterization with antifreeze in the holding tank.

Compliance details
The standard applies to all workers present during the shift. Mobile crews with immediate access to off-site facilities are exempt. Keep units clean and stocked. Document your setup in case of an inspection.

Post your site specifics for unit recommendations.

Three seats and three urinals is right for 95 workers under OSHA 1926.51 Table D-1. The 20 or more bracket is 1 toilet seat and 1 urinal per 40 workers, and 95 divided by 40 rounds up to 3.

The part I'd push back on is the ADA line. The ADA cluster rule comes from the 2010 ADA Standards, and section 203.2 exempts sites directly tied to the actual construction process. Crew only units on an active build don't trigger it. If the public or office staff share the same bank, that's a different conversation.

The Table D-1 footnote matters if your crew is all men. Urinals can stand in for seats in that case, but the seat count can never drop below two thirds of the minimum. With a minimum of 3, two seats is the floor, so you can't swap down to one toilet and a row of urinals.

On our sites we just order three standard units with the built in urinal, which covers seats and urinals in one go. Service frequency isn't set by 1926.51 at all, so we base it on how fast the tanks fill at that headcount and bump it once the crew peaks.

Also, the mobile crew exemption only covers crews with transportation readily available to nearby toilets. A fixed site with 95 people won't qualify for it.
