ADA 5 percent cluster rule

The ADA cluster rule is the provision in the 2010 ADA Standards for Accessible Design that, where multiple single-user portable toilets are clustered at one location, at least 5 percent of the units in each cluster must comply with the accessible toilet requirements and be identified with the International Symbol of Accessibility.

The rule applies per cluster, not per event. Ten clusters of four units each across a festival need an accessible unit in each cluster, not one accessible unit for the whole site. Rounding always goes up, so a cluster of one to twenty units needs one accessible unit.

The rule applies to places of public accommodation and government facilities. Private parties are not covered, but local permit offices often require accessible units for any event open to the public.
