2026: What's the OSHA rule for porta potties on a 75-worker site?

OSHA 1926.51 requires two portable toilets for 75 construction workers. The standard specifies one toilet seat and one urinal per 40 workers, so 75 workers fall into the 20 to 199 worker bracket requiring two units. You must provide at least two standard units or equivalent facilities.

ADA compliance is separate. If you cluster the units at one location, the ADA cluster rule applies. You need at least one ADA-compliant unit in that cluster for wheelchair access.

Service and placement matter for compliance. Weekly service visits are standard to keep units sanitary. Place them on level ground with clear truck access for pumping. Blocked units lead to missed service and potential violations.

For long-term sites, consider upgrading to a deluxe unit with a sink or a restroom trailer for crew comfort, but the minimum remains two units. What's your site setup? Ground conditions? Duration?

OSHA 1926.51 requires at least two portable toilets for a construction site with 75 workers. The rule for 20 to 199 workers is one toilet seat and one urinal per 40 workers. For 75 people, that means you need two standard units.

If you place both units together, you also need to follow the ADA cluster rule. This means at least one unit in the cluster must be an ADA-compliant unit for wheelchair access.

A weekly service visit is the standard to keep the units clean and compliant. Heavy use or hot weather means you need service more often. Place the units on level ground with clear truck access. If my truck can't reach a unit, it's a missed service.

For a long job, a deluxe unit with a sink or a restroom trailer can improve crew morale, but the OSHA minimum is still two units. The rental company will ask about your site's ground conditions and how long the job will last to give you a price.
