ADA cluster rule: if we have two clusters at an event, does each need an ADA unit?
Yes, if you have two separate clusters of portable toilets at your festival, each cluster requires its own ADA-compliant portable toilet. The ADA 5 percent cluster rule applies to each distinct grouping of units at a single location. Since your north and south ends are separate locations, each must have at least one accessible unit to comply with the 2010 ADA Standards for Accessible Design.
How the rule works
The standard requires that where multiple single-user portable toilets are clustered, at least 5 percent (but always at least one) must be accessible. Your two clusters are treated independently. Placing both accessible units at one end would not satisfy the requirement for the other cluster.
What defines a cluster
A cluster is a group of units placed together to serve a specific area, like each end of your festival grounds. Distance matters: if the groups are far apart or serve different zones, they are separate clusters. For a festival with alcohol and food service, proper distribution is also practical to prevent long waits.
Setting up your units
Ensure each ADA unit has a clear path of travel and level ground for approach. Check that service trucks can access both locations for pumping. Confirm with your local permit office if they have additional rules for special events.
