City says we need a permit for a porta potty on our property. Why?

Our house is down to the studs for a bathroom renovation that will take about six weeks. I ordered a single standard portable toilet for the crew of three and our family of four. The rental company dropped it on our paved driveway, which is flat and has plenty of room for their truck to pull right up. A few days later, a city inspector left a notice on the unit saying we need a permit for it. I'm confused. This is on our private property, not the sidewalk or street. It's for a private renovation, not a party or event. Why would the city require a permit for a temporary toilet on my own driveway? Does this apply even for a single unit?

Many cities require a permit for any temporary structure on a property, including a standard portable toilet, even when it's for a private renovation on your own driveway. The permit process allows the city to verify the placement meets zoning, setback, and health code requirements. Your single unit for a small crew is likely compliant with the OSHA 1926.51 standard for construction sites, which requires one toilet for 20 or fewer workers.

Permit requirements are not about the number of units or whether it's for an event. They are about the structure's impact on the neighborhood, such as visibility from the street, proximity to property lines, and ensuring proper waste disposal procedures are followed. The rental company typically handles the disposal, but the city still needs to track the unit's presence.

Contact your city's building or code enforcement department. Ask for the specific ordinance that applies. They may issue the permit quickly since your standard portable toilet is on a paved, level driveway with good truck access. Failing to get the permit can result in fines.
