Missed service because our dumpster delivery blocked the porta potty. Who is responsible?

Our Phoenix job site has six standard portable toilet units on compacted dirt. The rental company comes every Tuesday for the service visit. Yesterday, the trash hauler delivered a new dumpster and parked it directly in front of the cluster, completely blocking truck access. The service driver showed up, couldn't get the vacuum truck to the units, and left. Now I have a bill for a missed service.

The rental contract says we must maintain clear access. But the dumpster delivery was unannounced. The crew is complaining, and the units are getting full. Who is responsible for this missed service charge? Is it on me to coordinate between the trash company and the rental company, or should the rental company absorb the cost when access is blocked by a third party?

You are responsible for the missed service charge. The rental contract places the obligation on the site to maintain clear truck access for every scheduled service visit, regardless of which third party causes the blockage.

Your job site needs to manage all deliveries and subcontractors to ensure the vacuum truck can reach the cluster. The driver cannot wait for the situation to be resolved; their schedule is packed with 40 to 60 stops. A blocked unit is logged as a missed service, and the trip is billed because the driver and truck were dispatched. This is standard industry practice to cover the cost of the attempted service.

To fix this, you need to coordinate with the trash hauler immediately to move the dumpster. Then, call your rental company to schedule an emergency service visit, which will likely be an additional charge. For the future, establish a clear zone for the portable toilets and communicate the access requirement to every contractor on site.
