OSHA 1926.51: Do inspectors count temporary workers in our total?
OSHA 1926.51 counts every worker on site, including temporary workers, toward the total for toilet provisioning. You must provision for 45 toilets on days when you have 35 full-time crew plus 10 temporary workers.
OSHA's headcount rule includes all workers present, regardless of employment status. The standard requires one toilet seat and one urinal per 40 workers for sites with 20 to 199 workers. With 45 workers, you need two toilet seats and two urinals. You can meet this with two standard portable toilets or one deluxe portable toilet that includes a urinal.
Temporary workers count because they are on site performing work. OSHA inspectors will include them in the total. Failure to provide adequate facilities can result in citations.
Plan for the peak to avoid violations. Order units based on your maximum daily headcount, not your average. Coordinate with the temp agency to know when extras are coming. Ensure truck access for service visits.
