OSHA 1926.51: 180 workers on a November 2026 site. Toilets and urinals?

OSHA 1926.51(c) requires 5 toilets and 5 urinals for 180 workers on a construction site. The standard specifies one toilet seat and one urinal per 40 workers for sites with 20 to 199 employees. You need to meet this minimum regardless of season or project duration.

Unit types and placement
Use standard portable toilets for most units. Add one ADA-compliant portable toilet per cluster to comply with the ADA 5 percent cluster rule. Place them on level ground with clear truck access for weekly service.

Winter considerations
In November, operators use brine or non-toxic antifreeze in the holding tank to prevent freezing. Avoid flushing units or handwash stations with fresh water tanks, as they freeze solid. Staking units is critical if you get high winds.

Service and compliance
Schedule weekly service visits for pumping, deodorizer recharge, and restocking. Document this to avoid OSHA citations. For a crew of 180, expect heavier use, so monitor and request extra service if units fill up mid-week.
Post any follow-ups on crew size changes or site specifics.

Five seats and five urinals is right for 180, because Table D-1 in 1926.51 calls for 1 toilet seat and 1 urinal per 40 workers once you hit 20 or more, and 180 divided by 40 rounds up to 5.

Two things in the post I'd push back on though.

The ADA part doesn't apply to a crew only setup. Section 203.2 of the 2010 ADA Standards exempts portable toilets used only by construction workers, so the ADA cluster rule kicks in when the public uses the bank, not for your guys. Plenty of supers still put one in for an injured worker, which is a good call, just not a legal one.

Also watch the swap rule. If no women use the facilities you can trade urinals for seats, but seats can never drop below two thirds of the minimum. And if headcount grows past 200 the table changes to 1 seat and 1 urinal per 50 workers.

Weekly service visits aren't in the standard either. On my jobs with 10 hour days a bank that size needed more than once a week. Go by fill level, not the calendar.
