Porta Potty Forum

Kitchen remodel wrapped two weeks ago and the contractor's porta potty is still on our driveway. Can I call for pickup myself?

Our contractor set up the rental for his crew back in August, and the account is in his company's name, not ours. The last guys packed up on the 10th and the unit has just been sitting at the end of the driveway since. I've texted him twice and got a thumbs up both times, but nothing has happened. Now our HOA sent a courtesy letter Friday saying it needs to be gone or we get a violation.

As far as I can tell it still gets serviced every week, so somebody is still paying for it. Can I call the rental company directly and ask them to haul it, or will they only take that from whoever is on the contract? Is there any risk to us if I do? And honestly, is it rude to go around him on this?

You cannot call the rental company for pickup yourself because the contractor holds the rental agreement. A rental company requires authorization from the account holder to remove a unit. Contact the contractor again with a clear deadline, citing the HOA violation notice, and request immediate action. If he does not respond, you can call the rental company to report an abandoned unit, but they may still need to contact the contractor for confirmation. There is no direct risk to you, but the contractor remains responsible for any fees. It is not rude to escalate this after multiple ignored requests, especially with an HOA violation pending. The unit is likely a standard portable toilet with weekly service visits for odor control and waste removal, which explains why it is still being maintained.
